Supplier impact management and duty of care

Who is concerned by the duty of vigilance?

As corporate social responsibility expands, companies need to take into account the social, environmental and governance risks associated with their operations, as well as those of their subcontractors and suppliers. In this context, supplier performance can be monitored using specific indicators.

The duty of care is a French and soon European obligation for ordering companies to identify and prevent social, environmental and governance risks linked to their operations, the activities of their subsidiaries and their business partners (subcontractors and suppliers). In France, the law of February 21, 2017 provides the framework for this duty of care, the aim of which is to ensure that large companies, and multinationals in particular, take into account respect for human rights and the environment.

It concerns French companies employing at least 5,000 people in France, and those with over 10,000 employees in France and head offices elsewhere in the world. These companies must draw up and publish a due diligence plan to prevent environmental, human rights and corruption risks in their own activities, as well as those of their subsidiaries, subcontractors and suppliers, both in France and abroad.  

The duty of care is enshrined in the major international reference texts for multinationals.
