The duty of care
The duty of care is an obligation imposed on ordering companies to prevent social, environmental and governance risks related to their operations, but which can also extend to the activities of their subsidiaries and business partners (subcontractors and suppliers). In France, it is the law of 21 February 2017 that frames this duty which aims to ensure that the respect of human rights by large companies and in particular multinationals is taken into account.
It concerns French companies that employ at least 5,000 employees in France and those with more than 10,000 employees in France with their headquarters elsewhere in the world. They must establish and publish a vigilance plan to prevent risks to the environment, human rights and corruption on their own activities but also those of their subsidiaries, subcontractors and suppliers, in France and abroad.
